Imagine you are a policeman and confronted by someone who appears in some way threatening, who then reaches into his pocket to fetch out what may be a handgun. How would you react? My own first reaction would be, fearing the worst, to draw my own revolver. Perhaps with little further provocation, and out of fear, I might actually fire, unwittingly possibly committing a murder. Feeding my fear is the realization that in large parts of the country, handguns are legally obtained, and even legally carried in a concealed manner. So, could I be blamed for discharging my weapon with very little provocation?
After all, gun laws in the United States vary considerably, and are independent of existing federal firearms laws, although they are sometimes broader or more limited in scope than the federal laws. Firearm owners are subject to the firearm laws of the state they are in, and not exclusively their state of residence. Reciprocity between states exists in certain situations, such as with regard to concealed carry permits. These are recognized on a state-by-state basis. For example, Idaho recognizes an Oregon permit, but Oregon does not recognize an Idaho permit. Florida issues a license to carry both concealed weapons and firearms, but others license only the concealed carry of firearms. Some states do not recognize out-of-state permits to carry a firearm at all, so it is important to understand the laws of each state when traveling with a handgun.
CONCLUSION
With such a chaotic situation, is it any wonder why we have such gargantuan numbers of firearm deaths in this country that also include inadvertent police shootings? Although a simple answer to this question is evasive, we should have uniform national regulations that provide sensible limitations. Despite widespread misinterpretation, the second amendment is not applicable in this situation, for our founders referred to the regulation of “militias” and not to individuals as it is presently applied.
